How to make a complaint under the Disability Act

Complaints made under the Disability Act 2005 must be treated somewhat differently to complaints about services generally.

There are two areas under the Disability Act with specific procedures for complaints – these are the assessment of need for people with disabilities (part 2 of the Act) and access to buildings, services and information (part 3 of the Act).

Assessment of need for people with disabilities

Part 2 of the Disability Act provides for the Assessment of Need of people with disabilities and the drawing up of service statements. The assessment of need is currently limited to children under 5 years old.

There is an independent complaints and appeals procedure in place for the assessment of need process.

If you have a complaint about the assessment of need process, you should first contact the Disability Complaints Officer in the HSE. You may complain to a Disability Complaints Officer about any of the following:

  • A decision by the assessment officer that a child does not have a disability
  • A failure to carry out the assessment in accordance with standards set by the Health Information and Quality Authority (HIQA)
  • A failure to carry out the assessment within the time limits
  • The contents of the service statement provided to you
  • A failure to provide a service specified in the service statement

Complaints must be made within three months. In many cases, the officer may try to resolve the complaint informally. If this fails or is not appropriate, the Complaints Officer will formally investigate the complaint. You and the other people involved, for example, the assessment officer or the various service providers must be heard and given the opportunity to present evidence. The Complaints Officer must issue a report that includes findings and recommendations. Complaint proceedings are held in private.

Disability Appeals Officer

You can appeal to the Disability Appeals Officer against:

  • A finding or a recommendation of the Complaints Officer
  • The failure of the HSE or education service provider to implement a complaints officer’s recommendations

You must lodge an appeal within six weeks. The appeals officer can investigate the appeal in a number of different ways, including by an oral hearing held in private. The appeals officer’s decision will be in writing and will be sent to you and to the service providers involved. You may appeal the decision to the High Court on a point of law.

Access to buildings, services and information

Part 3 of the Disability Act provides for your rights to access buildings, services and information. If you wish to make a complaint about any of these areas, or about the failure to comply with any provision of Sectoral Plans published by various Government departments, you should first complain to a Complaints Officer within the department or agency. If you are dissatisfied with their actions you can then complain to the Office of the Ombudsman who has statutory responsibility under the Disability Act as well as under the Ombudsman Act.

Conas gearán a dhéanamh faoin Acht um Míchumas

Féach ar an Acht um Míchumas 2005 ar láithreán gréasáin Leabhar Reachtaíochta na hÉireann.

Caithfear déileáil le gearáin a dhéantar faoin Acht um Míchumas 2005 ar bhealach atá beagán difriúil le gearáin a dhéantar faoi sheirbhísí i gcoitinne.

Tá dhá réimse faoin Acht um Míchumas a bhfuil nósanna imeachta speisialta iontu maidir le déileáil le gearáin – is iad sin measúnú ar riachtanais do dhaoine faoi mhíchumas (cuid 2 den Acht), agus rochtain ar fhoirgnimh, ar sheirbhísí agus ar fhaisnéis (cuid 3 den Acht).

Measúnú ar riachtanais do dhaoine faoi mhíchumas

Forálann Cuid 2 den Acht um Míchumas go ndéanfar measúnú ar na riachtanais atá ag daoine faoi mhíchumas agus go ndréachtófar ráitis seirbhíse. Tá an measúnú riachtanais teoranta faoi láthair do dhaoine faoi bhun 5 bliana d’aois.

Faigh amach tuilleadh faoin bpróiseas maidir le measúnú a dhéanamh ar riachtanas ar citizensinformation.ie.

Tá nós imeachta neamhspleách gearán agus achomharc ann don phróiseas measúnaithe ar riachtanais.

Má tá gearán agat faoin mheasúnú ar riachtanais ba cheart duit teagmháil a dhéanamh ar dtús leis an Oifigeach Gearán sa FSS. Is féidir leat gearán a dhéanamh le hOifigeach Gearán maidir le ceann ar bith díobh seo a leanas:

  • Cinneadh ón oifigeach measúnaithe nach bhfuil míchumas ort
  • Mainneachtain an measúnú a dhéanamh de réir na gcaighdeán atá leagtha amach ag an Údarás um Fhaisnéis agus Cáilíocht Sláinte (ÚFCS)
  • Mainneachtain an measúnú a dhéanamh laistigh de na teorainneacha ama
  • Ábhair an ráitis seirbhíse a sholáthraítear duit
  • Mainneachtain seirbhís a shonraítear sa ráiteas seirbhíse a sholáthar

Caithfear gearáin a dhéanamh laistigh de thrí mhí. I gcuid mhaith cásanna, d’fhéadfadh an t-oifigeach iarracht a dhéanamh an gearán a réiteach go neamhfhoirmiúil. Má theipeann air/uirthi a leithéid a dhéanamh déanfaidh an tOifigeach Gearán imscrúdú foirmiúil ar an ngearán. Caithfear éisteacht leatsa agus leis na daoine eile lena mbaineann, mar shampla, an t-oifigeach measúnaithe nó na soláthraithe seirbhíse éagsúla, agus caithfear deis a thabhairt duitse agus dóibh siúd go léir fianaise a chur i láthair. Ní mór don oifigeach gearán tuairisc a eisiúint a bhfuil torthaí agus moltaí san áireamh inti. Reáchtáiltear imeachtaí gearán go príobháideach.

Is féidir sonraí teagmhála na nOifigeach Gearán do dhaoine faoi mhíchumas a fháil ar láithreán gréasáin FSS.

Oifigeach Achomhairc do dhaoine faoi Mhíchumas

Is féidir leat achomharc a dhéanamh chuig an Oifigeach Achomhairc do dhaoine faoi Mhíchumas in aghaidh:

  • Toradh nó moladh ón Oifigeach Gearán
  • Mainneachtain FSS nó soláthraí seirbhíse oideachais chun moltaí an oifigigh ghearán a chur i bhfeidhm

Ní mór duit achomharc a lóisteáil laistigh de sé seachtaine. Féadfaidh an tOifigeach Achomhairc achomharc a imscrúdú ar bhealaí éagsúla lena n-airítear éisteacht ó bhéal a thionól go príobháideach. Beidh cinneadh an oifigigh achomhairc i scríbhinn agus seolfar chugat é agus chuig na soláthraithe seirbhíse lena mbaineann sé. Is féidir leat achomharc a chur chuig an Ard-Chúirt maidir leis an gcinneadh ar phointe dlí.

Rochtain ar fhoirgnimh, ar sheirbhísí agus ar fhaisnéis

Forálann Cuid 3 den Acht um Míchumas go bhfuil cearta agat chun foirgnimh, seirbhísí agus faisnéis a rochtain. Más mian leat gearán a dhéanamh faoi aon cheann de na réimsí seo, nó mar gheall ar aon mhainneachtain maidir le géilleadh d’aon fhoráil de na Pleananna Earnála arna bhfoilsiú ag ranna Rialtais éagsúla, ba cheart duit gearán a dhéanamh ar an gcéad dul síos le hOifigeach Gearán na roinne nó na gníomhaireachta sin. Má tá tú míshásta lena gcuid gníomhartha is féidir leat gearán a dhéanamh ansin chuig Oifig an Ombudsman a bhfuil freagracht reachtúil uirthi faoin Acht um Míchumas agus faoin Acht Ombudsman chomh maith.

Is féidir leat níos mó a fháil amach inár leathanach faoi ghearán a dhéanamh le hOifig an Ombudsman.
